1. Eligibility to Use Our Platform

To create an account, browse full website functionality, and submit orders on Melville Travel, you must meet the following minimum eligibility requirements:

  • You are at least 18 years of age, or the legal age of majority in your jurisdiction of residence, and you have the full legal capacity to enter into a binding purchase contract under applicable local laws.
  • If you are accessing our platform on behalf of a business entity, you confirm that you have full legal authority to bind that entity to these Terms of Service, and both you and the entity agree to be held fully responsible for all activity carried out under your account.
  • You are not located in any region subject to international trade sanctions, or listed on any restricted trade party list issued by the Government of Canada, the United Nations, or your local national government.
  • You do not have multiple suspended, banned, or previously terminated accounts on our platform due to prior policy violations, fraudulent activity, or abuse of our customer support and return systems.

We reserve the full right to refuse access to our website, cancel accounts, or reject orders at our sole discretion if we have reasonable grounds to believe any user has violated these eligibility requirements, or is using our platform for unauthorized, fraudulent, or harmful purposes.

2. Intellectual Property Rights

All content, assets, and materials available on www.melvilletravel.com are the exclusive intellectual property of Melville Travel, and are protected by global copyright, trademark, trade dress, and other intellectual property laws. This content includes, but is not limited to: all website page designs, original product photography, product descriptions, brand logos, graphic assets, website code, copywriting, video content, user interface layouts, and all text related to our brand story of making every trip lighter, smoother, and far more memorable.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use our website for your personal, non-commercial shopping purposes only. You may not reproduce, modify, distribute, publicly display, republish, mirror, or frame any part of our website content, product images, or brand assets for any commercial or public use without our explicit prior written permission. You may not scrape our website content, harvest product pricing data, or copy our original product descriptions to post on third-party e-commerce platforms without our written approval. Any unauthorized use of our intellectual property will constitute a violation of these Terms of Service, and we reserve the right to pursue all available legal remedies to enforce our rights, including claiming compensation for any losses incurred from such unauthorized use.

3. User Account Responsibilities

If you choose to register for a “My Account” profile on our platform to save your shipping details, track order history, access exclusive member discounts, and save preferred items to your wishlist, you agree to the following account-related responsibilities:

  • You must provide accurate, complete, and up-to-date contact information including your full legal name, valid email address, working phone number, and correct shipping addresses, and update this information promptly if any of your details change.
  • You are fully responsible for maintaining the confidentiality of your account password, and for all activities, orders, and actions that take place under your account, whether you have authorized that activity or not.
  • You must immediately notify our support team if you become aware of any unauthorized access to your account, password leak, or suspicious activity on your profile. We will never ask you to share your full account password via email, text message, or phone call, and you agree to never share your account credentials with any third party.
  • You may not create or operate multiple Melville Travel accounts to evade purchase limits, abuse promotional discount codes, bypass return policy restrictions, or create fake positive reviews for our products. We reserve the right to terminate all related duplicate accounts immediately if we detect this type of activity.

We cannot and will not be held liable for any loss or damage arising from your failure to secure your account credentials, or provide accurate up-to-date account information.

4. Product Information, Pricing, and Order Submission Policies

We take extreme care to make all details about our 120+ travel gear products, including product descriptions, images, specifications, functionality notes, and displayed prices, as accurate as possible on our website. That said, we acknowledge that accidental human or technical errors may occasionally occur:

  • All product prices listed on our website are denominated in Euros, and are subject to change at any time without prior notice, before you successfully complete the payment process for your order. The price confirmed at the moment your payment is successfully processed is the final price that will be charged to you for that order.
  • While we use high-resolution product photography to showcase every luggage tag, passport cover, toiletry bag, and travel accessory on our store, minor visual variations in color, texture, or finish may occur due to differences in individual device screen display settings. These minor variations do not qualify as product defects.
  • Very rarely, a product may be listed at an incorrectly low price due to a typographical error, system glitch, or outdated inventory sync issue. If we discover that a product you ordered was priced incorrectly, we will contact you as soon as possible to inform you of the error, and offer you the option to either confirm your order at the correct accurate product price, or cancel your order for a full 100% refund with no additional charges. We are not obligated to honor incorrectly listed erroneous prices.
  • All orders you submit via our checkout page constitute a legally binding purchase offer sent to Melville Travel. We reserve the full right to accept or reject your order for any reason, including but not limited to product stock unavailability, errors in product or pricing information, detection of fraudulent payment activity, suspicion of reseller bulk purchasing that violates our retail customer policies, or if your shipping location is subject to unexpected courier service disruptions. Your order is only officially confirmed and a binding contract is formed between you and Melville Travel after we send you a formal order confirmation email following successful payment verification.
  • We enforce a fair limit of 10 units of any single travel product per individual customer order, to prevent bulk resellers from stockpiling popular items and preventing regular retail customers from accessing our inventory. We reserve the right to cancel any order that exceeds this reasonable purchase limit, or any order that we reasonably suspect is being placed for commercial resale purposes without our prior written wholesale agreement.

5. Payment and Billing Terms

All payments for orders placed on our website are processed through fully PCI DSS-compliant, secure third-party payment processors. We do not store full credit card, debit card, or sensitive payment details on our own internal servers, to protect your financial data. By submitting an order, you confirm that you are the authorized user of the payment method you use to complete your purchase, and that you have sufficient available funds to cover the full cost of your order, including all applicable product prices, selected shipping fees, and any applicable local sales tax or import duties as outlined in our Shipping Policy.

If a payment is flagged as suspicious, high-risk, or subject to fraud detection holds by our payment service provider, our team may reach out to you to request additional verification documentation including a copy of your government-issued photo ID, or a copy of the billing statement linked to your payment method, before we process and ship your order. This verification step is implemented to protect both our customers and our business from unauthorized fraudulent card use. If you do not provide the requested verification documentation within 10 calendar days, we reserve the right to cancel your order in full and process a refund back to your original payment method.

6. Prohibited Uses of Our Platform

When accessing www.melvilletravel.com, you agree that you will not use our website for any of the following prohibited activities:

  • Violating any applicable local, national, or international law, regulation, or judicial order that applies to your use of our platform or purchase of our travel products.
  • Impersonating any other person, business entity, or Melville Travel team member, or falsifying your identity or account information to gain unauthorized access to our services or exclusive promotions.
  • Uploading, transmitting, or distributing any malicious software, viruses, malware, harmful code, or other digital tools designed to disrupt, damage, or compromise the functionality of our website, servers, or related technology infrastructure.
  • Carrying out any activity that disrupts or degrades the performance of our website, including running automated bot traffic, launching denial of service attacks, or placing excessive automated bulk order requests that overwhelm our warehouse and processing systems.
  • Copying, scraping, or harvesting data about other Melville Travel customers, team members, or website users, for the purpose of sending unsolicited commercial messages, phishing scams, or other types of unauthorized harassment.
  • Using our platform to resell, distribute, or export our travel products in violation of applicable trade control, customs, or consumer protection laws in your jurisdiction.
  • Submitting false, misleading, or abusive product reviews, fake fraud claims, or invalid “refund only” requests that violate our published Refund and Returns Policy, to gain unauthorized monetary compensation at the expense of our business.

Any violation of these prohibited use clauses will result in immediate temporary or permanent suspension of your access to our platform, cancellation of all pending unshipped orders, and we reserve the right to report any illegal activity to relevant law enforcement authorities where required.

7. User-Generated Content Rules

Our platform may allow registered users to submit product reviews, photo testimonials, feedback messages, and other forms of user-generated content to be displayed on our product pages, social media channels, or marketing materials. When you submit any user-generated content to Melville Travel, you confirm that:

  • You own the full legal copyright and intellectual property rights to the content you are submitting, and you have obtained written permission from any identifiable third parties featured in photos or videos included in your content.
  • You grant Melville Travel a perpetual, worldwide, royalty-free, fully transferable license to use, reproduce, modify, distribute, edit, and publicly display your user-generated content for any lawful business purpose, including marketing campaigns, social media posts, and website promotional content, without requiring additional compensation to you.
  • Your submitted content is not illegal, offensive, defamatory, harassing, sexually explicit, racist, discriminatory, or violates the legal rights of any third party.

We reserve the full right to moderate, edit, or remove any user-generated content submitted to our platform at our sole discretion, if we determine the content violates these rules, harms our brand reputation, or infringes on third party rights. We are not obligated to publish every piece of submitted content on our website.

8. Disclaimers of Warranties

Our website and all travel gear products sold through our platform are provided on an “as is” and “as available” basis, to the fullest extent permitted by applicable law. Melville Travel makes no express or implied warranties of any kind, including but not limited to implied warranties of merchantability, fitness for a specific travel purpose, and non-infringement of intellectual property rights, beyond the mandatory warranty protections that cannot be excluded under applicable consumer protection laws in your jurisdiction.

We do not guarantee that access to our website will be uninterrupted, 100% error-free, or completely secure at all times. Our website may occasionally be temporarily unavailable for scheduled maintenance, server upgrades, security patches, or emergency technical repairs, and we are not liable for any loss of sales, productivity, or other damages you incur as a result of temporary website downtime. All our travel products are covered by a 12-month manufacturer warranty against original manufacturing defects, details of which are listed in our Refund and Returns Policy. This limited warranty is the sole warranty offered for all our products.

9. Limitation of Liability

Under no circumstances will Melville Travel, our directors, employees, partners, suppliers, or affiliated service providers be held liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website, or any products you purchase through our platform, including but not limited to lost profits, lost travel savings, lost trip plans, data loss, or personal injury, beyond the maximum total amount you actually paid to us for the specific order or service that gives rise to your claim.

This limitation of liability applies regardless of the legal theory the claim is based on, including breach of contract, tort (including negligence), or violation of statutory consumer rights, even if we have been advised of the possibility of such damages in advance. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so some parts of this limitation clause may not apply to you, depending on your local laws.

10. Indemnification Obligations

You agree to fully defend, indemnify, and hold harmless Melville Travel, our directors, officers, employees, contractors, agents, suppliers, and service partners from any and all claims, demands, lawsuits, losses, liabilities, expenses, fines, or costs (including reasonable legal attorney fees) that arise from or are related to:

  • Your violation of any clause outlined in these Terms of Service.
  • Your violation of any applicable local, national, or international law, or the legal rights of any third party, in connection with your use of our website or our travel products.
  • Any user-generated content you submit to our platform that infringes on the copyright, trademark, privacy, or other legal rights of an external third party.
  • Any dispute or issue that arises from your use of our travel products in a manner that violates the official product usage guidelines provided by our team.

11. Modifications to Terms of Service

We reserve the right to update, revise, or modify these Terms of Service at any time at our sole discretion, to reflect changes in our business operations, new product launches, updated regulatory requirements, or improvements to our service offerings. When we make material changes to these terms, we will update the “Effective Date” posted at the top of this page, post a prominent notification banner on the homepage of our website, and send an email alert to all registered account holders with details of the upcoming changes at least 30 days before the new revised terms go into effect. Your continued use of our website, browsing our product catalog, or placing new orders after the revised terms take effect will constitute your full acceptance of the updated Terms of Service.

12. Governing Law and Dispute Resolution

These Terms of Service are governed by, and interpreted in full accordance with, the laws of the Province of British Columbia and the federal laws of Canada applicable in the province. Any dispute, controversy, or claim arising out of or related to these Terms of Service, your use of our website, or any product purchase you make from Melville Travel will first be submitted to good faith, non-binding mediation, to be held in Vancouver, British Columbia, for a period of no less than 30 calendar days, before any formal legal action is initiated. If the dispute cannot be resolved through mediation, both parties agree to submit to the exclusive personal and subject matter jurisdiction of the provincial and federal courts located in Vancouver, British Columbia, Canada.

If any individual clause of these Terms of Service is determined to be invalid, unenforceable, or illegal by a court of competent jurisdiction, the remaining valid clauses of the agreement will remain in full force and effect, and will continue to be legally binding on both parties. Our failure to enforce any provision of these Terms of Service at any point in time does not constitute a permanent waiver of that provision, or our right to enforce that clause at a later date.
